Changes to Flexible Working Rights
Overview
The Employment Rights (Flexible Working) Act 2023 comes into force on 6 April which give
employees further rights in respect of requesting flexible working.
What do I need to know?
The following changes are coming into force:-
1. Removal of Continuous Service Requirement
Removal of the need for employees to have 26 weeks’ continuous service before
making a formal flexible working request. This means employees can request flexible
working from the first day of employment.
2. Increased Frequency of Requests
Employees are allowed to make two flexible working requests within a 12-month
period, as opposed to one request previously.
3. Reduced Time Limit for Employers to Respond
Employers are to respond to flexible working requests within two months as
opposed to three months previously, although this two month response time can be
extended if the employee agrees.
4. Consultation Requirement for Employers
Employers are required to consult with employees before refusing a flexible working
request and must explain the reason/s for the decision.
5. Removal of Justification Requirement for Employees
Elimination of the need for employees to provide justification for the proposed
changes to their working arrangements, to simplify the process for employees.

Ensure you respond to any employee flexible working requests by meeting the above legal
requirements.
